EMA Consulting has published complimentary and user-friendly Guidance Notes on Consultation. They join the suite of useful resources available free on EMA Consulting’s webpage. The notes contain practical explanations and useful examples of when and how and employer can fulfil its obligations –and potentially avoid disputes, delays and penalties – when introducing change.

In the last year, we have noticed a general increase in complaints and reported cases alleging non-compliance with consultation obligations in awards, agreements and legislation. We have also encountered clients reluctant to embrace them because of other pressures.


Formal consultation obligations are not merely aspirational – if they are not done correctly delays will inevitably follow and civil (pecuniary) penalties are a real possibility. Our Notes explain your obligations, the limits of consultation, and practical suggestions and examples of how to go about it effectively.
